The telling phrase is "cover 95% of their customers". Imagine the US First Amendment modified to protect your right to say anything you want provide 95% of the people approve and are already saying it. If there were competitive marketplace it would be one thing but as long as a carriers are given control over our First Amendment rights they have an obligation to at least pretend to honor the US Constitution as written and not just their modified version that looks the same to 95% of the people. [ You forget Bob, that the 1st Amendment doesn't generally apply to private situations, even ones where the entities involved have massively benefited from virtual government-granted monopoly status, both in the past and in many cases today in a practical sense in many areas. Also, assuming accurate numbers, that's 95% *today*. It's particularly telling that the various ISP estimates of "bandwidth used by video" under their caps are virtually always stated in terms of SD (standard definition) videos. You virtually never see them list how many HD movies would fit in their caps -- since the number would be so low.
