Hmmm.  So the result will be:

1.  ISPs will treat all traffic the same instead of sniffing them to
decide which are "good" and which are, in their opinion, "evil" and
deserving of destruction;

2.  ISPs and Users will have to have a clear understanding of the
amount of bandwidth that comes with their service;

3.  ISPs will have to deal with users that exceed that agreement by
either charging them more or

4.  terminating their service

So what's wrong with that?

How does the above affect those that you consider "innocent and
honest?"  Why would someone who is using BitTorrent not be assumed to
also be "innocent and honest?"

And speaking of innocent and honest, which party is being innocent and
honest in this case?  The P2P user who thought he was buying unlimited
Internet Access at a clearly stated bandwidth or the ISP who failed to
clearly disclose that there was a limit until he enforces it ex post
facto?
